Business License Agreement
Last Updated: October 22, 2026
This Business License Agreement (the "Agreement") is between We Are Calculator ("we", "us") and the business that creates a business account or embeds our calculators ("you"). By creating a business account, ticking the agreement box at sign-up, or placing our embed code on a website, you agree to this Agreement on behalf of your business, and you confirm you are at least 18 and authorized to bind that business.
This Agreement adds to our Terms & Conditions and Privacy Policy. If they conflict, this Agreement applies to your business account.
1. Definitions
- Service: the business dashboard, embeddable calculators, lead capture and delivery, integrations, and related features.
- Embed: the code we provide that displays a calculator on your website.
- Registered Domains: the websites listed on your Domains page.
- Visitor: a person who uses a calculator on your website.
- Lead: the details a Visitor submits through the form under your calculator, together with their inputs and results, as defined on our What Counts as a Lead page.
- Lead Data: all information contained in Leads.
2. Your licence
While your account is active and you comply with this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to display the calculators you have enabled, through the Embed, on your Registered Domains, and to use the dashboard to receive and manage your Leads.
3. What you may not do
- Display the calculators anywhere other than your Registered Domains, or help anyone else do so.
- Copy, modify, reverse engineer, scrape, frame outside the Embed, or create derivative works of the calculators, their formulas, code or content.
- Resell, rent, sublicense, or present the calculators as your own product.
- Remove or obscure our attribution, notices or disclaimers built into the Embed.
- Get around plan limits, domain restrictions or security measures, including by creating multiple accounts.
- Submit fake leads, test the Service with automated traffic beyond reasonable testing, or interfere with its operation.
- Use the Service for anything unlawful, deceptive, or harmful, including collecting information under false pretences.
4. Your responsibilities for Leads
- Your follow-up is yours. You decide how to contact Visitors and are responsible for complying with the laws that apply to you, including privacy, anti-spam and telemarketing laws (for example CASL in Canada, and CAN-SPAM and the TCPA in the United States), and any licensing, advertising or disclosure rules for your profession.
- Your privacy notice. You must have a privacy notice on your website that tells Visitors you collect their information through the calculator form and how you use it.
- Consent wording. You are responsible for any disclaimer or consent text you add in Branding being accurate and sufficient for your use of Leads.
- Visitor requests. You will handle requests from Visitors to access, correct or delete their information, and you can delete Leads from your dashboard. We will help where reasonably needed.
- Your destinations. When you connect an email address, webhook, CRM or third-party tool, you confirm you are allowed to send Lead Data there. Each destination is governed by its provider's own terms.
5. Lead Data and privacy
- Ownership. As between you and us, you own your Lead Data.
- Our role. We process Lead Data on your behalf to provide the Service: to capture, store, deliver and display Leads, prevent spam and abuse, keep billing records, and keep the Service secure. We do not sell Lead Data, and we do not use it to market to your Visitors.
- Details. How we store, protect and retain Lead Data, and which service providers we use, is described on How We Handle Lead Data.
- Security. We use reasonable technical and organizational measures to protect Lead Data. If we become aware of unauthorized access to your Lead Data, we will notify you without undue delay.
- Usage data. We may use aggregated, de-identified information about how the Service is used to operate and improve it.
6. Plans and fees
- The Free plan currently includes one active calculator, one Registered Domain and 10 Leads per calendar month. When the limit is reached, the form stops accepting new Leads until the next month.
- Paid plans are not yet available. When they are, fees, included Leads and any per-Lead charges will be shown before you subscribe, and Leads will be counted under the rules on What Counts as a Lead, including the dispute process.
- You will never be charged unless you choose a paid plan. Fees are exclusive of taxes, which you are responsible for.
- We may change plans, limits or prices with at least 30 days' notice by email or in your dashboard. Changes to a paid plan take effect at your next billing period.
7. Our intellectual property
We and our licensors own the Service, the calculators, their formulas, code, design and content, and all related intellectual property. Your logo, business name and branding remain yours, and you allow us to display them in your Embed and in emails we send for you. If you send us feedback, we may use it without obligation to you.
8. Third-party services
Integrations such as HubSpot, Zapier, your webhook endpoint or your email provider are run by third parties. We are not responsible for their availability, how they handle data once delivered, or changes they make that affect an integration.
9. Availability and delivery
We aim to keep the Service available and to deliver Leads promptly, retrying failed deliveries automatically. Your dashboard is the authoritative record of your Leads. Emails, webhooks and integrations are best-effort and may be delayed or fail. We do not currently offer a service-level agreement. We may change, add or remove features, and will give reasonable notice of changes that materially reduce the Service.
10. No financial advice
The calculators provide estimates for general information only and are not financial, tax, legal or lending advice, offers, or quotes. You must not present calculator results as personalized advice, a guaranteed rate or an approval. See our Disclaimer.
11. Disclaimer of warranties
To the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any number of Leads will be generated.
12. Limitation of liability
To the extent permitted by law: (a) neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, business or data; and (b) our total liability arising out of or relating to this Agreement is limited to the greater of the fees you paid us in the 12 months before the claim and CAD $100. These limits do not apply to your breach of sections 3 or 4, or to amounts you owe us.
13. Indemnity
You will defend and indemnify us against third-party claims, losses and reasonable costs arising from your use of Leads, your website or follow-up communications, content you provide (including branding and disclaimers), or your breach of this Agreement or applicable law.
14. Term, suspension and termination
- This Agreement starts when you create an account or first use the Embed, and continues until your account is closed.
- You can stop at any time by removing the Embed and deleting your account in Settings, which permanently deletes your Leads and settings. Export anything you want to keep first.
- We may suspend or close your account if you breach this Agreement, if your use creates legal or security risk, or if required by law. Where reasonable, we will tell you first and give you a chance to fix the problem.
- We may end the Service for all customers with at least 60 days' notice.
- When this Agreement ends, your licence ends and you must remove the Embed. Sections 5, 7, 10 to 13, 15 and 16 continue to apply.
15. Changes to this Agreement
We may update this Agreement. We will post the new version here with a new date and, for material changes, notify you by email or in your dashboard at least 30 days before they take effect. Continuing to use the Service after that date means you accept the changes. If you don't agree, you may close your account before then.
16. General
- Governing law. This Agreement is governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. The courts of British Columbia have exclusive jurisdiction, except that either party may seek urgent injunctive relief anywhere.
- Entire agreement. This Agreement, together with the Terms, Privacy Policy and the pages linked above, is the entire agreement about the Service.
- Assignment. You may not assign this Agreement without our consent. We may assign it as part of a merger, acquisition or sale of the Service, with notice to you.
- Severability and waiver. If any part is unenforceable, the rest remains in effect. Not enforcing a term is not a waiver of it.
- Force majeure. Neither party is liable for delays caused by events beyond its reasonable control.
- Notices. We send notices to your account email. You can send notices to us at the address below.
